By accessing or using Still Here, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our service. Please read these terms carefully.
1. Acceptance of Terms
By creating an account, downloading, accessing, or using the Still Here mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").
These Terms constitute a legally binding agreement between you and Still Here. If you do not agree to these Terms, you must not use our Service.
- You must be at least 13 years old to use this Service
- If you are under 18, you must have parental or guardian consent
- You must provide accurate and complete information
- You are responsible for maintaining the security of your account
2. Service Description
Still Here is a daily check-in application designed to provide peace of mind for people living alone and their loved ones.
2.1 Core Features
Our Service includes:
- Daily Check-ins: A system for users to confirm their well-being daily
- Emergency Contact Notifications: Automatic alerts to designated contacts if check-ins are missed
- AI Companion Chat: Optional conversational support and companionship
- Check-in History: Records of your daily check-ins and streaks
2.2 Service Availability
We strive to provide reliable service, but we do not guarantee that the Service will be available at all times or without interruption. We may:
- Modify or discontinue features with or without notice
- Perform scheduled maintenance that may cause temporary unavailability
- Experience unplanned outages or technical difficulties
3. User Accounts
3.1 Account Creation
To use Still Here, you must create an account by providing:
- A valid email address
- A secure password
- Your name (or preferred name)
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring your account information is accurate and up-to-date
3.3 One Account Per Person
You may only create one account. Creating multiple accounts may result in suspension or termination of all your accounts.
4. User Responsibilities
4.1 Acceptable Use
You agree to use Still Here only for lawful purposes. You will not:
- Use the Service to harass, abuse, or harm another person
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use automated means (bots, scripts) to access the Service
- Reverse engineer, decompile, or disassemble the Service
- Collect or harvest any personal information from other users
- Use the Service for any illegal or unauthorized purpose
4.2 Emergency Contact Accuracy
You are responsible for:
- Ensuring your emergency contacts are accurate and current
- Obtaining consent from individuals before adding them as emergency contacts
- Informing your emergency contacts about how the Service works
- Updating contact information when it changes
4.3 Check-in Responsibility
While we send reminders, you are ultimately responsible for performing your daily check-ins. We are not liable if you forget to check in.
5. Emergency Services Disclaimer
IMPORTANT: Still Here is NOT an emergency service and should NOT be relied upon as a substitute for professional emergency services.
5.1 Not a Medical Service
Still Here:
- Is not a medical device or medical service
- Does not provide medical advice, diagnosis, or treatment
- Should not be used as a replacement for medical monitoring systems
- Cannot detect medical emergencies or health conditions
5.2 Call Emergency Services
In case of a medical or other emergency, always call your local emergency services (911 in the US, 112 in Europe, etc.) immediately. Do not rely on Still Here to summon emergency help.
5.3 Notification Limitations
We cannot guarantee that:
- Notifications will be delivered instantly or at all
- Emergency contacts will receive or respond to notifications
- The Service will be available when needed
- Technical issues won't prevent notifications from being sent
5.4 User Assumption of Risk
By using Still Here, you acknowledge and accept that the Service has limitations and you assume all risks associated with relying on the Service for safety or emergency purposes.
6. Subscriptions and Payments
6.1 Free and Paid Plans
Still Here offers both free and paid subscription plans:
- Free Plan: Basic features with limited AI chat messages
- Premium Plan: All features including unlimited AI chat, priority support, and ad-free experience
6.2 Subscription Terms
- Subscriptions are billed monthly or annually based on your selection
- Your subscription automatically renews unless you cancel
- Prices are subject to change with 30 days' notice
- You can cancel anytime through your account settings
6.3 Payment Processing
- Payments are processed through third-party payment providers (Apple, Google, etc.)
- You authorize us to charge your payment method on a recurring basis
- Failed payments may result in service suspension
- All fees are non-refundable except as required by law
6.4 Cancellation and Refunds
- You can cancel your subscription at any time
- Cancellation takes effect at the end of your current billing period
- No refunds for partial months or unused services
- Upon cancellation, you'll have access until the end of the paid period
7. Intellectual Property
7.1 Our Rights
The Service, including all content, features, functionality, software, text, graphics, logos, and trademarks, is owned by Still Here and is protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the Service for personal, non-commercial purposes
- Download and use the mobile application on your devices
7.3 Restrictions
You may not:
- Copy, modify, or create derivative works of the Service
- Distribute, sell, rent, or license the Service
- Remove any copyright or proprietary notices
- Use our trademarks without written permission
7.4 Your Content
You retain ownership of any content you submit (chat messages, profile information, etc.). By using the Service, you grant us a license to use, store, and process your content solely to provide the Service.

You may terminate your account at any time by:

- May make errors or provide inaccurate information
- Should not be relied upon for important decisions
10. Limitation of Liability
10.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STILL HERE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from unauthorized access to your account
- Damages from interruption or cessation of the Service
- Damages from errors, mistakes, or inaccuracies of content
- Damages resulting from failure to send or receive notifications
10.2 Maximum Liability
Our total liability to you for all claims arising from or relating to the Service shall not exceed the greater of:

- The amount you paid us in the 12 months before the claim arose

- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Any content you submit through the Service
- Your negligence or willful misconduct
12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

- Notify you through the app or via email
- Request your acceptance for material changes
12.2 Your Acceptance
